End user terms
Last updated: [date]
These terms are between Embertail, a trading name of [your full legal name] (“we”), and the organisation that installs Pivot & Roll-up Reports for Jira (“you”). By installing or using the app you agree to them. They sit alongside Atlassian’s Marketplace terms, which cover buying and billing.
1. Licence
We give you a non-exclusive, non-transferable licence to use the app with your Atlassian site for as long as you have a valid licence through the Atlassian Marketplace, including its free trial. You may let anyone with access to your site use it.
You may not copy, resell, reverse engineer or try to get around the app’s limits or security, except where the law allows.
2. Your data
You keep all rights to your data. The app stores it in your site’s Atlassian Forge storage; we don’t receive it (see our Privacy policy and Data and security). You are responsible for who you give access to and for the content of your reports.
3. AI features
AI features suggest report layouts and short explanations. They can be wrong: check important results before relying on them. Each site has a monthly limit on AI requests, which we may change with notice.
4. Fees
Paid licences are bought and billed through the Atlassian Marketplace at the prices shown there. Refunds follow Atlassian’s Marketplace policies.
5. Support and changes
We provide support by email on a reasonable-efforts basis. We may update the app to improve it, fix problems or meet Atlassian’s requirements. We’ll try not to remove major features from a paid licence during its term.
6. Warranty
We will make reasonable efforts to keep the app working as described. Otherwise the app is provided “as is”, and, to the extent the law allows, we give no other warranties, such as that it will be error-free or uninterrupted.
7. Liability
Nothing in these terms limits liability that can’t be limited by law, such as for death or personal injury caused by negligence, or fraud. Otherwise, to the extent the law allows:
- we aren’t liable for indirect or consequential loss, or loss of profit, revenue or data; and
- our total liability in any 12 months is limited to the fees you paid for the app in those 12 months.
8. Ending
You can stop using the app at any time by uninstalling it. We may suspend or end your licence if you seriously break these terms. If we stop offering the app, we’ll give at least 90 days’ notice where we can.
9. General
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If a part of these terms can’t be enforced, the rest still applies. We may update these terms; the version at this address applies, and we’ll note significant changes on What’s new.
